تقرير الأمم المتحدة: أوضاع حقوق الإنسان في العراق لا تزال هشة
بغداد/جينيف، 8 آب/أغسطس 2011 – حذّر تقرير صادر عن الأمم المتحدة حول أوضاع حقوق الإنسان في العراق أثناء العام 2010 من أن أعمال العنف المسلحة والإنتهاكات "الصامتة" لحقوق الإنسان لا تزال تلحق الضرر بشرائح كبيرة من السكان.
ويدرس التقرير الذي أصدرته اليوم بعثة الأمم المتحدة لمساعدة العراق (يونامي) ومفوضية الأمم المتحدة لحقوق الإنسان مجموعة من القضايا ذات العلاقة بحقوق الإنسان بما في ذلك أثر النزاع المسلح وأعمال العنف على المدنيين، فضلاً عن الإعتقالات وسيادة القانون وحماية حقوق مجموعات معينة. كما يُغطي هذا التقرير أوضاع الحقوق السياسية في البلاد بما في ذلك الحق في التجمع والتعبير. وقد أشار التقرير إلى أنه رغم ظهور تحسن في بعض المجالات، فإن العديد من التحديات لا تزال ماثلة.
وأشار التقرير موضحاً أن "إنتشار الفقر والركود الإقتصادي وشح الفرص والتداعيات البيئية والإفتقار للخدمات الأساسية هي بمثابة إنتهاكات "صامتة" لحقوق الإنسان حيث أنها تؤثر على العديد من شرائح السكان."
كما يُشير التقرير إلى أن "أعمال العنف المسلحة لا تزال تؤثر سلباً على البنى التحتية المدنية،" مسترسلاً بأن أعمال العنف تلك تُفضي إلى فقدان الحياة والإصابة بجروح على نحو عشوائي، فضلاً عن محدودية الحصول على الحقوق الأساسية الأخرى بما في ذلك الحق في الحصول على الخدمات الإنسانية الأساسية والحق في التجمع وحرية التعبير وحرية الدين.
ووفقاً لتقديرات حكومية ولتقديرات بعثة الأمم المتحدة لمساعدة العراق فإن زهاء 3000 مدني قضوا نحبهم جرّاء أعمال العنف التي استمرت أثناء عام 2010 والتي إرتكب جلها جماعات مسلحة متمردة وجماعات إرهابية. وتستمر معاناة الأشخاص الذين ينتمون إلى الأقليات والنساء والأطفال من العنف العشوائي والموجه بصورة غير متناسبة. ولا يزال إنفاذ القانون وإقامة العدل يعانيان من مشاكل كبيرة لاسيما فيما يتعلق بتوفير وإحترام الإجراءات القانونية وحقوق الحصول على محاكمة عادلة. وبينما لاحظ التقرير بعض التحسن في الأوضاع المادية في مراكز الإحتجاز والسجون، إلا أن الكثير من التقارير لا تزال تفيد عن وجود حالات إساءة معاملة وتعذيب. ولاحظ التقرير أن الإعتماد المفرط على الإعترافات كأساس للإدانة يساعد على إيجاد بيئة يتم فيها تعذيب المعتقلين.
ويقول التقرير "إن وضع حد للإفلات من العقاب يشكل تحدياً جدياً في العراق، حيث لا يزال أولئك الذين إرتكبوا جرائم على مر السنين غير مساءلين. وقد تم خلال العام الحالي إكتشاف مقابر جماعية تضم رفات العديد من ضحايا جرائم حقوق الإنسان التي إرتكبت في أوقات مختلفة خلال العقود القليلة الماضية."
ويلاحظ التقرير أيضاً تراجع حقوق المرأة على نحو ما عام 2010 وإستمرار معاناة الأطفال جراء العنف والنزاع المسلح، إذ يتم أحياناً تجنيد الأطفال أو إستغلالهم للقيام بأعمال عنف، وعانت الأقليات أيضاً من العديد من الهجمات.
ويشير التقرير إلى أن "أوضاع حقوق الإنسان في العراق لا تزال هشة"، كما يقدم عدداً من التوصيات لمعالجة التحديات الضخمة التي يواجهها العراق حكومة وشعباً.
وتم جمع المعلومات التي وردت في التقرير من خلال الرصد المباشر الذي قامت به البعثة ومن مصادر أخرى متنوعة بما في ذلك الحكومة ووكالات الأمم المتحدة والمجتمع المدني والمنظمات غير الحكومية.

Human rights situation in Iraq remains fragile – UN report
BAGHDAD/GENEVA, 8 August 2011 – A UN report into the human rights situation in Iraq over the course of 2010 has warned that armed violence and "silent" human rights violations continue to affect large sectors of the population.The report, released today by the UN Assistance Mission for Iraq (UNAMI) and the Office of the High Commissioner for Human Rights, studies a range of human rights issues, including the impact of armed conflict and violence on civilians, detention and the rule of law, and protection of the rights of specific groups. The report also covers the state of political rights in the country, including freedom of assembly and expression. It noted that while there was improvement in some areas, many challenges remain."Widespread poverty, economic stagnation, lack of opportunities, environmental degradation and an absence of basic services constitute 'silent' human rights violations that affect large sectors of the population," the report notes."Armed violence continued to impact negatively on civilian infrastructure," the report notes, adding that such violence not only leads to arbitrary loss of life and injury, but also limits access to other basic rights, including the right to access basic humanitarian services, and the rights of assembly, freedom of expression and freedom of religion.According to UNAMI and Government estimates, around 3,000 civilians were killed in ongoing violence in 2010, largely perpetrated by armed insurgents and terrorist groups. Members of minorities, women and children continue to suffer disproportionately from indiscriminate and targeted violence. Significant problems remain with law enforcement and the administration of justice, especially in relation to the provision and respect for due process and fair trial rights. While the report noted some improvement in the physical conditions of many detention facilities and prisons, incidents of abuse and torture remain widely reported. An over-reliance on confessions to convict encourages an environment where the torture of detainees takes place, the report notes."Ending impunity also remains a serious challenge in Iraq," the report states. "Perpetrators of crimes committed over many years continue to be unaccountable. A number of mass graves were discovered during the year containing the victims of various human rights abuses committed at various times over the past few decades."The report also notes that women's rights in some ways deteriorated in 2010 and children continue to suffer from violence and armed conflict, in some instances having been recruited or used to commit acts of violence. Minorities suffered from a number of attacks."The human rights situation throughout Iraq remains fragile," the report notes.
