السلام عليكم -تحيه طيبه لكل المهتمين بقضية حقوق الاشخاص المعوقين في المنطقه نبعث تقرير مجريات وتوصيات موتمر مسقط حول سياسات الاعاقه في المنطقه مع التقدير

سياسات التعامل مع الإعاقة ومشكلاتها وآفاقها في
الدول العربية في ضوء الاتفاقية الدولية لحقوق الأشخاص ذوي الإعاقة
الترحيب بقرار مجلس وزراء الشؤون الاجتماعية العرب، بإدراج حقوق الأشخاص ذوي الإعاقة ضمن الأولويات العربية للتنمية ما بعد 2015
وتأكيد على أهمية دمج النساء ذوات الإعاقة على نحو مناسب وكاف في جميع السياسات والبرامج الرامية إلى تحقيق المساواة بين أفراد الجنسين
بتنظيم من الأمانة العامة لإدارة التنمية والسياسات الاجتماعية بالأمانة الفنية لمجلس وزراء الشؤون الاجتماعية العرب وبالتعاون مع وزارة التنمية الاجتماعية في سلطنة عمان، عقدت الندوة حول سياسات التعامل مع الإعاقة ومشكلاتها وآفاقها في الدول العربية في ضوء الاتفاقية الدولية لحقوق الأشخاص ذوي الإعاقة وذلكفي 26 ايار/ مايو الجاري في فندق الانتركونتيننتال في مسقط بمشاركة ممثلين عن 19 دولة عربية ومنظمات عربية واقليمية.
وقد تمثلت المنظمة العربية للأشخاص ذوي الإعاقة بكل من المديرة العامة للمنظمة الأستاذة جهدة ابو خليل وممثل سلطنة عمان في المنظمة السيد محمود الوائلي.كما شارك رئيس الاقليم العربي في المنظمة الدولية للأشخاص ذوي الإعاقة السيد موفق الخفاجي. ورئيس الاتحاد العربي للمكفوفين الدكتور خالد النعيمي والأمين العام لمجلس الأشخاص ذوي الإعاقة في ولاية كردفان(السودان) السيد محمد سومي كافي ورئيس الجمعية العمانية للمعوقين السيد يحي العامري وبعض اعضاء مجلس ادارتها.
تخلل الجلسة الافتتاحية كلمات لكل من رئيس وحدة التنسيق والمتابعة بمكتب رئيس القطاع الاجتماعي في جامعة الدول العربية السيد طارق النابلسي ومدير عام الرعاية الاجتماعية في وزارة التنمية الاجتماعية في سلطنة عمان السيد حمود اليحيائي، والسيد عوض السميرات باسم الوفود العربية المشاركة. واكدت الكلمات على ان العديد من الدول العربية قد خطت خطوات هامة بهدف تحسين اوضاع وادماج الأشخاص ذوي الإعاقة في ضوء اتفاقية حقوق الأشخاص ذوي الإعاقة وما تنص عليه. كما لفت السيد اليحيائي الى اقرار استرتيجية وطنية للتعامل مع الاعاقة في سلطنة عمان.
وتضمنت الجلسة الافتتاحية تدشين لنظام الاجهزة التعويضية الآلي للأشخاص ذوي الإعاقة حيث قدمت الدكتورة كوثر بنت ثاني الخايفية مديرة تقنية المعلومات بوزارة التنمية الاجتماعية في سلطنة عمان شرحاً مفصلاً حول النظام.
ومن ثم عقدت جلسات العمل حيث قدمت عدة اوراق استعرضت الموضوعات التالية:

*مراجعة القوانين والتشريعات العربية في ضوء اتفاقية حقوق الأشخاص ذوي الإعاقة.
*المؤشرات المناسبة لقياس تاثير السياسات والخطط والبرامج على اوضاع الأشخاص ذوي الإعاقة في
الدول العربية.
*مقاربة تنموية لقضية الاعاقة وافاقها والتحديات التي تواجهها.
*التحديات والصعوبات الى تواجه تقديم خدمات الرعاية والـاهيل لفئات التوحد.
وقد تلا عرض الاوراق نقاش ومداخلات للمشاركين. وكان لرئيس الاقليم العربي في المنظمة الدولية
للأشخاص ذوي الإعاقة السيد موفق الخفاجي مداخلة واقتراح لجهة حث الدول العربية على التوقيع والتصديق على البروتوكول الخاص بالاتفاقية. وقد ادرجاقتراحه ضمن توصيات المؤتمر.
كما قدمت المنظمة العربية للاشخاص ذوي الاعاقة عدة توصيات منها ما يتعلق بالنساء ذوات الاعاقة، وبذل الجهود لتعزيز اعمال البحث وجمع البيانات الخاصة بالأشخاص ذوي الاعاقة والتأكيد على حق الأشخاص ذوي الإعاقة في الحصول علىالتعليم الدامج، وايضاً ادرجت جميعها ضمن التوصيات النهائية التي اقرتها الندوة.
وقد تلا في ختام المؤتمر السيد طارق النابلسي التوصيات النهائية، ومن ثم قام وزير التنمية الاجتماعية
في سلطنة عمان السيد محممد بن سعيد بن سيف الكلباني بتوزيع الشهادات على جميع المشاركين.
وفيما يلي التوصيات التي خلصت لها الندوة.
1.دعوة الدول العربية التي صادقت على الاتفاقية الدولية لحقوق الأشخاص ذوي الإعاقة الاستفادة من القانون العربي الاسترشادي لحماية حقوق الأشخاص ذوي الإعاقة المقرر إصداره من مجلسي وزراء العدل والشؤون الاجتماعية العرب،بما يساعد الدول الأعضاء على تكييف قوانينها الوطنية الخاصة بالأشخاص ذوي الإعاقة وبما يتلاءم مع أحكام الاتفاقية
وما ينبغي ان تكون عليه.
*مراجعة القوانين والتشريعات العربية في ضوء اتفاقية حقوق الأشخاص ذوي الإعاقة.

2-.دعوة مجلس وزراء الشؤون الاجتماعية العرب بالتنسيق مع الجهات ذات العلاقة في الدول العربية، وبالتعاون مع منظمات الأمم المتحدة ومنظمات المجتمع المدني ذات العلاقة مواصلة تنظيم دورات تدريبية للمسؤولين في الدول العربية لكتابة تقارير تنفيذ الاتفاقية الدولية لحقوق الأشخاص ذوي الإعاقة، وفقاً لمعاير كتابة التقارير المعتمدة من الأمم المتحدة، وبما يسهم فيتعزيز جهود الدول الأعضاء لتنفيذ متطلبات الاتفاقية.
3.نشر القانون العربي الاسترشادي لحقوق الأشخاص ذوي الإعاقة فور اعتماده على كافة وسائل الإعلام المسموع والمرئي والالكتروني، وطباعة القانون بلغة برايل ولغة الاشارة لتعميم الاستفادة منه على أوسع نطاق ممكن في الدول العربية.
4.التأكيد على قيام الإعلام في الدول العربية بدور إيجابي فاعل في تغيير نظرة المجتمع السلبية إلى نظرة إيجابية للإعاقة باعتبارها جزء من التنوعوالاختلاف البشري وتأكيد حقهم في العمل والاندماج في المجتمع.
5.التأكيد على أهمية إنشاء قاعدة بيانات عربية حول الإعاقة لتكون مرجعاً عربياً في هذا الشأن.
6.دعوة الدول العربية التي لم تصادق على البروتوكول الاختياري للمصادقة عليه.
7.اعتماد الأطر القانونية المناسبة والكافية لحماية الأشخاص ذوي الإعاقة من التمييز لتشجيع التكافؤ في الحصول على الوظائف والأعمال اللائقة، بما في ذلك التدريب المهني المناسب.
8.تهيئة البنى التحتية بما يضمن وصول الأشخاص ذوي الإعاقة إلى المباني وأماكن الخدمات الأساسية ووسائل النقل وبرامج تكنولوجيا المعلومات.
9.اعتبار إدراج الأشخاص ذوي الإعاقة في المسار التنموي مسؤولية وطنية لكل القطاعات المعنية، ولا تحمل فقط على وزارات الشؤون الاجتماعية أو منظمات المجتمع المدني ذات العلاقة لأنها مسؤولية الجميع في المجتمع.
10.الترحيب بقرار مجلس وزراء الشؤون الاجتماعية العرب، في دورته الاستثنائية (المملكة الأردنية الهاشمية 12 مايو / آيار 2014)، الذي تضمن إدراج حقوق الأشخاص ذوي الإعاقة ضمن الأولويات العربية للتنمية ما بعد 2015.
11.توفير برامج التأهيل وإعادة التأهيل للأشخاص ذوي الإعاقة الذهنية والأشخاص المصابين بالتوحد بصفة خاصة، بجودة عالية تتناغم والمعايير المعتمدة دولياً من خلال استقراء وتحليل الممارسات النموذجية المطبقة في دول العالم ذات الريادة في هذا الخصوص.
12.الطلب من مجلس وزراء الشؤون الاجتماعية العرب بالتعاون مع وزارة التنمية الاجتماعية في سلطنة عمان إصدار مطوية معرفية للتوحد وتعميمها على الدول العربية للاستفادة منها.
13.التأكيد على أهمية دمج النساء ذوات الإعاقة على نحو مناسب وكاف فيجميع السياسات والبرامج الرامية إلى تحقيق المساواة بين أفراد الجنسين.
14.التأكيد على حق الأشخاص ذوي الإعاقة في الحصول على التعليم الجيد الدامج مع إعارة انتباه خاص إلى إمكانية الوصول وتوفر المدرسين المدربين على لغة الإشارة والتكنولوجيا المساعدة ولغة برايل وغيرها.

.15بذل الجهود لتعزيز أعمال البحث وجمع البيانات الخاصة بحقوق الأشخاص ذوي الإعاقة التي تسمح بتعريف مناسب للبرامج والسياسات ومتابعتها، وبما في ذلك إيجاد المؤشرات المناسبة لقياس آثرها.
16.إزالة الحواجز التشريعية وحظر التمييز على أساس الإعاقة فيما يختص بجميع المسائل المتعلقة بكافة أشكال العمالة وفيها شروط التوظيف والتعيينوالعمل واستمراره، والتقدم الوظيفي وظروف العمل الآمنة والصحية.
17.اعتماد الاتجاه الحقوقي في فهم الإعاقة وأنواعها باعتبارها نتاج عوامل متداخلة تلعب فيها العوائق البيئية والحواجز السلوكية الدور الأساسي التي تمنع من ممارسة الحقوق والحريات العامة للأشخاص ذوي الإعاقة.
18.دعوة الدول العربية إلى الاستفادة مما ورد في التقرير الذي أعدته الاسكوا بالتنسيق مع جامعة الدول العربية حول الإعاقة في المنطقة العربية – لمحة عامة ودعوة الاسكوا إلى استكمال جهودها في هذا الشأن
16.إزالة الحواجز التشريعية وحظر التمييز على أساس الإعاقة فيما يختص بجميع المسائل المتعلقة بكافة أشكال العمالة وفيها شروط التوظيف والتعيينوالعمل واستمراره، والتقدم الوظيفي وظروف العمل الآمنة والصحية.
17.اعتماد الاتجاه الحقوقي في فهم الإعاقة وأنواعها باعتبارها نتاج عوامل متداخلة تلعب فيها العوائق البيئية والحواجز السلوكية الدور الأساسي التي تمنع من ممارسة الحقوق والحريات العامة للأشخاص ذوي الإعاقة.
18.دعوة الدول العربية إلى الاستفادة مما ورد في التقرير الذي أعدته الاسكوا بالتنسيق مع جامعة الدول العربية حول الإعاقة في المنطقة العربية – لمحة عامة ودعوة الاسكوا إلى استكمال جهودها في هذا الشأن

within the Arab priorities for the development of the post- 2015
And emphasize the importance of integration of women with disabilities in all policies and programs aimed at achieving equality
Organized by the Secretariat of the Department of Development and Social Policy with the Technical Secretariat of the Council of Arab Social Affairs Ministers, and in collaboration with the Ministry of Social Development in the Sultanate of Oman, held the seminar on policies dealing with disability challenges and perspective in the Arab countries in the light of the International Convention on the Rights of Persons with Disabilities , in the 26th of May 2014, at the Intercontinental Hotel in Muscat, with the participation of representatives from 19 Arab countries and the Arab and regional organizations

During the opening session, speeches by the chair of the Coordinating Unit and the Office of the President of follow-up social sector in the Arab League, Mr. Tarik Al-Nabulsi, Director General of Social Welfare and the Ministry of Social Development in the Sultanate of Oman , Mr. Hammond Yahyai , Mr. Awad Asameerat on behalf of the Arab delegations participating . All the speeches confirmed that many Arab countries have taken important steps in order to improve the conditions and the integration of persons with disabilities in the light of the Convention on the Rights of Persons with Disabilities.
Also Mr. Yahiya highlights on the national strategy to deal with disability in the Sultanate of Oman.
The opening session included the launch of Prosthetics automated system for persons with disabilities presented by Dr. Kawthar Alkhavih Director of Information Technology at the Ministry of Social Development in Oman, where she discussed the system and how it works.
The opening session followed by different sessions, where presented several papers deals with the following topics:
* Monitor database for persons with disabilities in the Arab region and evaluate what are the implications and what should be.
*Guiding Arab Law for the Protection of the Rights of Persons with Disabilities,
* Review the laws and legislation in the light of the Convention on the Rights of Persons with Disabilities.
* Appropriate indicators to measure the impact of policies, plans and programs on the situation of persons with disabilities in the Arab countries.
* Development approach to the issue of disability and prospects and challenges.
* The challenges and difficulties facing the provision of care services and parents of autism.
The presentation was followed by discussion and interventions from the participants. The chair of DPI Arab Region Mr. Mowaffak al-Khafaji, suggest a proposal to urge the Arab states to sign and ratify the optional Protocol of the CRPD, which was approved and listed within the proposed recommendations of the seminar.
Also Mr. Yahiya highlights on the national strategy to deal with disability in the Sultanate of Oman.
The opening session included the launch of Prosthetics automated system for persons with disabilities presented by Dr. Kawthar Alkhavih Director of Information Technology at the Ministry of Social Development in Oman, where she discussed the system and how it works.
The opening session followed by different sessions, where presented several papers deals with the following topics:
* Monitor database for persons with disabilities in the Arab region and evaluate what are the implications and what should be.
*Guiding Arab Law for the Protection of the Rights of Persons with Disabilities,
* Review the laws and legislation in the light of the Convention on the Rights of Persons with Disabilities.
* Appropriate indicators to measure the impact of policies, plans and programs on the situation of persons with disabilities in the Arab countries.
* Development approach to the issue of disability and prospects and challenges.
* The challenges and difficulties facing the provision of care services and parents of autism.
The presentation was followed by discussion and interventions from the participants. Also the Arab Organization of Persons with Disabilities presented several recommendations , including that of women with disabilities , efforts to promote the issue of research and data collection for persons with disabilities and to emphasize the right of persons with disabilities to have access to adequate education , and also all these recommendations included within the seminar final recommendations.
In the last session, Mr. Tarik Al-Nabulsi, read the final recommendations, and then the Minister of Social Development in Oman Mr. Bin Saeed Bin Saif AlKalbani distributed the certificates to all the participants.
The following are the recommendations of the seminar
1. Calling on the Arab states that have ratified the International Convention on the rights of persons with disabilities to benefit from Guiding Arab Law for the Protection of the Rights of Persons with Disabilities, scheduled to adopt by both the Arab council of the Ministers of Justice and Social Affairs, including help Member States to adapt their national laws for persons with disabilities and in line with the provisions of Convention.
2. Calling on the Council of Arab Social Affairs Ministers in coordination with the relevant authorities in the Arab countries , and in collaboration with the United Nations organizations and civil society organizations to continue organizing training courses for officials in the Arab countries on writing national reports about the implementation of the International Convention on the Rights of Persons with Disabilities , according to the standards writing reports approved of the United Nations.
3. Publishing the Arab law on the rights of persons with disabilities as soon as it is adopted, through all media audio-visual and electronic, and in Braille and sign language and circulated as widely as possible in the Arab countries.
In the last session, Mr. Tarik Al-Nabulsi, read the final recommendations, and then the Minister of Social Development in Oman Mr. Bin Saeed Bin Saif AlKalbani distributed the certificates to all the participants.
The following are the recommendations of the seminar
1. 6. Invite the Arab states that have not ratified the Optional Protocol to ratify it.
7. Adoption of appropriate legal frameworks and adequate to protect persons with disabilities from discrimination, to promote equality in access to employment and decent work, including vocational training course.
8 . Creating infrastructure to ensure access for persons with disabilities to buildings and places of basic services, transport and information technology programs.
9 . Taking into consideration the inclusion of persons with disabilities in the development process as a national responsibility for all sectors concerned, not only the ministries of social affairs or civil society organizations related to it, it is also the responsibility of everyone in the community.
10 . Welcome the decision of the Council of Arab Social Affairs Ministers, at its special session (Kingdom of Jordan May 12 / May 2014), which included the inclusion of the rights of persons with disabilities within the Arab priorities for development beyond 2015.
11. Provide rehabilitation programs for people with intellectual disabilities and people with autism in particular, within high-quality programs and internationally accepted standards, through analysis of exemplary practices applied in the world.
5. Emphasize the importance of creating an Arab database on disability to be as Arab reference in this regard.
6. Invite the Arab states that have not ratified the Optional Protocol to ratify it.
7. Adoption of appropriate legal frameworks and adequate to protect persons with disabilities from discrimination, to promote equality in access to employment and decent work, including vocational training course.

14. Emphasis on the right of persons with disabilities in access to integrated education, with special attention to accessibility and availability of trained teachers on sign language and assistive technology and Braille and others.
15. To promote the research and data collection on the Rights of Persons with Disabilities, which allows the definition of appropriate programs and policies and follow-up, and including the appropriate indicators to measure the impact.
16. Removal of legislative barriers and the discrimination on the basis of disability with regard to all matters concerning all forms of employment and the conditions of recruitment, hiring and employment , and its continuation , career advancement and safe working conditions and health .
17. Adoption the right approaches in dealing with different types of disability.
18. Calling on Arab states to get benefit of what is stated in the report prepared by ESCWA in coordination with the Arab League about disability in the Arab region - an overview and an invitation to complete the ESCWA efforts in this regard
13. Emphasize the importance of the integration of women with disabilities in a manner appropriate in all policies and programs aimed at achieving equality.
14. Emphasis on the right of persons with disabilities in access to integrated education, with special attention to accessibility and availability of trained teachers on sign language and assistive technology and Braille and others.
